SB 628

SB 628 provides for a tax credit tied to wages already paid at the agriculture overtime rate. This accomplishes two goals – it keeps the agriculture overtime law in place exactly as written by the Legislature (without revising the Labor Code) and provides the tax credit only after employees have been scheduled for, worked, and been paid overtime rates. 

  • This bill raises overtime hours for agricultural workers, which increases their take-home pay and eases the financial pressures faced by farmworkers.

  • This bill would accomplish this by introducing a payroll tax credit to reimburse agricultural employers for overtime wages paid to their agricultural employees. NOTE: “Overtime wages” means the difference between the employees’ overtime rate of pay and their regular rate of pay.

SB 628 helps increase the number of work hours available and the income of farmworkers.
